Man Arrested After Faulty Taillight Leads to Gun, Drug Charges

Getting pulled over by police is always nerve-wracking. What if you say or do something stupid and get arrested? While most drivers who get pulled over only get speeding or traffic tickets, some people do get arrested and charged with felony crimes.

This is what recently happened in the Tampa area. A traffic stop for a faulty taillight resulted in a significant bust. Police conducted a stop at a gas station near West Hillsborough Avenue and Sawyer Road. The driver, a 53-year-old man, exited the vehicle as police showed him the faulty light. That was when deputies noticed the driver holding a large wad of cash. The man explained that he worked at a club.

During a vehicle search, police discovered a stolen firearm, multiple quantities of cocaine and cannabis, plus more than $2,200 in cash. The deputy told the man that there may be a warrant for his arrest, which led to him being detained.

The driver was subsequently arrested and faces multiple felony charges, including possession of a firearm by a felon, possession of cocaine with intent to sell or deliver, and driving with a suspended license.

Possession of a Firearm by a Felon in Florida

In Florida, it is a serious crime for a convicted felon to possess, own, or control a firearm, ammunition, or electric weapon. Under Florida Statute § 790.23, this offense is classified as a second-degree felony, punishable by up to 15 years in prison, 15 years of probation, and a $10,000 fine.

Possession can be actual (physically holding the firearm) or constructive (having control over the place where it’s located, such as a car or home). Even if a felon claims the weapon belongs to someone else, prosecutors can still prove possession if they can show the individual had access or control.

Certain exceptions exist if the person’s civil rights and firearm rights have been restored through the state clemency process. However, until that happens, possession of any firearm or ammunition remains illegal. A conviction can result in long-term imprisonment and loss of future rights.
